What About the Criminal OWI Case?
In Indiana, a driver is considered to be operating a vehicle while impaired if his or her blood-alcohol content (BAC) is 0.08% or higher.
Note: for commercial drivers (such as large truck operators), the BAC limit is 0.04%. Likewise, drivers under the age of 21 face a lower BAC limit of 0.02%.
Some drivers are affected by alcohol even when their BAC is within the legal limit. In those cases, while DUI / DWI / OWI laws may not apply, the driver can still be held liable for negligent driving, such as speeding or swerving.
