No auto accident is a good thing. Catastrophic injuries or deaths always come as terrible surprises. But when the car crash is caused by a drunk driver, the damages are especially hard to comprehend. Driving while under the influence of alcohol or drugs isn’t just dangerous and foolish; it’s also illegal and profoundly unfair. The victims in these drunk driving accidents in Indianapolis are almost always innocent bystanders. They do not deserve to suffer serious injuries or the loss of life. Their families do not deserve to worry or grieve.
Unfortunately, as negligent and downright reckless as it is, people in Indianapolis get behind the wheel of a car while inebriated every day. This irresponsible behavior continues in spite of the tough penalties drivers face, often because they believe they won’t get caught or suffer consequences. The price of their selfishness is expressed in terms of bodily anguish, financial disaster, emotional distress, and even death. If you have been injured in an Indianapolis auto accident at the hands of a drunk or drugged driver—or if your loved one has been killed in a DUI/OWI crash—you deserve justice, and our personal injury lawyers can help you seek it.
While the law is incapable of undoing the harm that’s been done to you, the courts in our state can award you comprehensive financial justice, and our personal injury lawyers at Eskew Law are here to help you get the outcome you deserve. In Indiana, a driver is considered to be operating a vehicle while impaired if his or her blood-alcohol content (BAC) is 0.08% or higher.
Note: for commercial drivers (such as large truck operators), the BAC limit is 0.04%. Likewise, drivers under the age of 21 face a lower BAC limit of 0.02%.
Some drivers are affected by alcohol even when their BAC is within the legal limit. In those cases, while DUI / DWI / OWI laws may not apply, the driver can still be held liable for negligent driving, such as speeding or swerving.
Additionally, it is unlawful to drive while under the influence of medications. This includes not only illegal drugs but also over-the-counter and/or prescription medicine. Drivers who choose to operate a vehicle while using medications against a doctor’s or pharmacist’s instructions can be held accountable for the injuries they cause.
Unfortunately, drunk driving injuries tend to be very serious. That said, no two crashes are quite alike, and damages occur along a spectrum of severity. Common injuries include:
As Indianapolis drunk driving accident attorneys, we can help you bring a civil legal action against the driver and his or her insurers. This civil action proceeds separately from any criminal penalties the driver may face.
Civil litigation and criminal trials proceed in different courts and operate under different rules. Our office can help you understand your civil options, regardless of whether or when the driver is facing criminal charges.
Time matters in these cases. The sooner you get in touch with an experienced attorney regarding your rights, the better. Waiting too long could keep you from ever getting justice.
